TERMS AND CONDITIONS OF DEALING IN BUSSINESS W.E.F. 25 MAY 2020

Business Dealing:

  • Business dealing refers to any transactions, registrations or interactions between firms/ company and a current or prospective client, supplier or any other third party.

Price:

  • The prices of the goods would be as quoted in the printed rate list or on the website from time to time. We will continuously post the price of each item and will ensure its correctness, the firm/ company has the rights to amend if it is found that the prices are posted inaccurately inadvertently.
  • Rates of goods may be revised periodically by the firm/ company but that will not affect the orders which are already been confirmed.
  • Due to typographical/ human error, if rate of any product is posted lesser or more than the fixed price rate, the firm/ company has the right to correct it and the order will be executed after the confirmation from the client/ consumer. In case the client is out of contact besides the best efforts of the company, the order will be liable to be cancelled.
  • In case the order is placed online, the order will be executed only after the receipt of payment and its confirmation, the payment shall be made through RTGS, money transfer, debit card, credit card, and UPI payment or through net banking in terms of INR in the company’s bank account number.

Purchase order:

  • Purchase order placed by the customer is subject to acceptance by the CosmoTrend Inc. and availability of stock of the product(s) ordered. The execution of the order is subject to acknowledgment and the subsequent confirmation email. Non-confirmed orders will be subjected as cancelled and will not be executed. Once the order is dispatched, it will not be cancelled.

Dispatch and delivery of order:

  • CosmoTrend Inc. prioritizes on early dispatch of orders as soon as possible, the period of delivery will be considered as indicative only. The products enlisted as shortage due to technical reason will be dispatched at earliest date as possible. Cosmotrend Inc. will not be responsible for the delays caused by the courier services or the transporters.

Shipment of order:

  • As per the standard operating procedure (SOP) of our company, the system processed the order as per your confirmation; the product fitness is inspected prior to packaging. Our delivery partner ensures to deliver the order as per specified period. Delay in delivering the product may occur due to inevitable circumstances at rare occasions, in the aforesaid cases you will be notified though the e-mail regarding details of shipment, docket number and details of the courier company, which enables you to track your order.

Return Stock Management

  • The customer shall provide accurate and complete address at which the order is to be delivered. If the address provided is incomplete and inaccurate, Cosmotrend Inc. will not hold any liabilities.
  • CosmoTrend Inc. bears no risk once the parcel is out of the premises and in case the order is being lost/misplaced by the third party. If the goods received are in damaged condition, the same can be exchanged within 48 hours of delivery on your written request along with the original packaging of the goods parcel.
  • CosmoTrend Inc. will inspect and decide whether the returned goods are in good condition and are not for the purpose of exchange; accordingly you will be addressed on your e-mail regarding the decision taken. Inaccurate and false/ fake information provided by the customer for making exchange claim may invite legal action.
  • The damaged goods exchanged will be settled within 15 days from the date of receipt of such goods after being satisfied by the company in the light of inspection and the same will be intimated to you. No provision stands valid for refund, only exchange of goods is possible and permitted.
  • The rejection of claim due to incorrect order placed or in the event of incorrect address conveyed etc. or on being dissatisfied, the customer is not eligible for any kind of exchange or claim.

Cancellation of order

  • Cancellation of order is only possible once the order has not been dispatched by us or handled over to our delivery services.

Liabilities at our end

  • The supplies made against your order are exclusively meant for use of our products for domestic and personal purposes. CosmoTrend does not take any responsibility for any of its commercial use, resolve it or any loss of profit happened due to such activity.

Account Responsibility

  • CosmoTrend does not own any responsibility for security of your account. We advise that CosmoTrend site is to be used only by the adults not by any minor. The consumer is responsible for maintaining privacy/ confidentiality of his/her account, password access to computer systems. The information shared by you is not confidential or proprietary and does not make infringement right of third party.
  • You are solely responsible for uploading the information on our site or in the email etc. unparliamentarily contents will invite personal action / legal action. All rights are reserved with CosmoTrend to refuse service or and to terminate any account(s) with prior intimation to you.

User Contents

The information, text or other materials transmitted or otherwise made available to us (“User Content”), are entirely your responsibility and we will not be held responsible, in any manner whatsoever, in connection to the User Content. You agree to not encourage or assist or engage others as well as yourself in transmitting, hosting, displaying, uploading, modifying, publishing, transmitting, updating or sharing any information that

  • belongs to another person and to which the user does not have any right to;
  • is grossly harmful, harassing, blasphemous defamatory, obscene, pornographic, pedophilic, libelous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
  • harm minors in any way;
  • infringes any patent, trademark, copyright or other proprietary rights;
  • violates any law for the time being in force;
  • deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
  • impersonate another person;
  • contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
  • threatens the unity, integrity, defense, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.                  CosmoTrend Inc. in a way shall not be held responsible for examining or evaluating User Content, nor does it assume any responsibility or liability for the User Content.

CosmoTrend Inc. does not endorse or control the User Content transmitted or posted on the Site by you and therefore, accuracy, integrity or quality of User Content is not guaranteed by CosmoTrend Inc.

Intellectual Property rights

  • The Customer shall respect all license agreements delivered by the copyright owners. CosmoTrend cannot be held responsible or liable for any misuses conducted by the Customer or any third party.
  • All trademarks shown on www.Cosmotrendinc.in in belong to their registered owners and must not be copied without prior permission.
  • You must not use any part of the materials on the Website for commercial purposes without obtaining a license to do so from us or our licensors.

Changes to Terms & Conditions

We, CosmoTrend Inc. reserves the right to change these terms and conditions at any time without prior notice.

 

Governing Law & Jurisdiction
These Terms will be governed by and construed in accordance with the laws of the State of "PUNJAB", and you submit to the non-exclusive jurisdiction of the state and federal courts located in "SAS NAGAR" for the resolution of any disputes
